Highly contested; Intense custody and support dispute and achieved sole custody orders for my client/Father during litigation of custody issues. Achieved imputation of income of opposing party over opp ... osing party/counsel's objection at pre-judgment trial by use of vocational expert and other tools; Ultimately was able to achieve all goals for my client/Father on all issues, including custody, support orders, and property division issues. Successfully negotiated a favorable spousal support buyout/termination and property division for my client in a multi-million dollar estate. Successfully opposed attorney fee requests by opposing party.

OUTCOME: All issues resolved in collaborative divorce process

I have handled many collaborative cases, but this case was so smooth and so "textbook" that I have to share. The parties recognized that they did not want to spend their money on litigating their divo ... rce. One party did not feel comfortable mediating the divorce because he felt he needed an attorney by his side during negotiations. That is why collaborative was a great fit. It was the option that allowed them to save fees (relative to litigating) by staying out of court, and while having a certified mediator/collaborative attorney by their side during negotiations. The parties had custody disputes to work through, and this was successfully resolved with the help of a child specialist. The parties had a business that needed to be valued and analyzed to determine the key operator's income available for support, so a business valuation expert was hired who analyzed the business and explained to the parties the ranges of value/valuation methods and determined the key operator's income available for support. They reached an agreement on value and support at a far cheaper expert cost than had they litigated and each hired their own experts. The parties hired a neutral financial expert who prepared joint disclosures, educated the spouse with less knowledge about their financial picture, and acted as the neutral professional in facilitating agreements between the parties during collaborative sessions. The parties also each had divorce coaches by their side during all negotiations to assist in negotiations and to keep each party's emotions intact so as to not disrupt the progress of negotiations. With all of these issues and all of these experts, this case was completely resolved in less than 6 months. This case could not have been more smooth.

Mediated Divorce

OUTCOME: All issues successfully resolved in mediation

I was the mediator on this very high conflict mediation case. The parties had a a multi-million dollar community property estate with multiple businesses. The parties had separate consulting attorneys, ... substance abuse issues were involved, and there were complex custody issues. With the assistance of a co-mediator business valuation expert, a co-mediator estate planning attorney, and divorce coaches/therapists assisting when needed, we were able to resolve all issues of this case in mediation within 6 months. This is why it is smarter to mediate your divorce! At a minimum, divorcing couple should at least try. This couple would have spent tens of thousands more dollars in attorney and expert fees had one of them refused to try mediation.
