I hired the Crone Law Firm for assistance because FedEx Corporation violated the ADA employment laws and illegally terminated my long-term employment after I disclosed my breast cancer diagnosis and requested accommodation. Amanda failed to take seriously her obligation to represent me competently i...n the serious violations of the ADA. Amanda knows that breast cancer is a disability that is covered under the ADA; that FedEx’s refusal to engage in the mandatory interactive process and denying me reasonable accommodation is direct evidence of disability discrimination. In response to FedEx’s Position Statement, Amanda erroneously analyzed and presented my ADA claim to the EEOC under the reduction-in-force standard, knowing that failure to accommodate falls under the ADA laws, and is direct evidence of discrimination. Instead, she used the McDonnell Douglas burden shifting standard, which applies in indirect evidence cases. It was not that Amanda applied the ADA laws wrongly in my disability discrimination claim, but that she did not apply the ADA laws at all. Amanda’s failure to apply the proper ADA laws to my claim deprived me of protection under the ADA laws. Because of her misrepresentation, I was deprived of my civil rights and liberties under the ADA laws.
