Jun 15, 2020OUTCOME: NY state court refused to dismiss a claim that MetLife engaged in consumer fraud, and refused to dismiss a claim for attorneys' fees
In Hunt v. MetLife, a New York state court upheld a claim that MetLife engaged in consumer fraud. The court held that the Plaintiff adequately pleaded that MetLife engaged in consumer fraud. Plaintiff ... alleged that MetLife (i) systematically misapplied the terms of its long term disability policies and (ii) conducted a sham evaluation of Plaintiff’s claim that was not intended to get to truth of whether Plaintiff was actually disabled. The court also allowed a claim for attorneys’ fees to move forward. https://www.riemerhess.com/news/riemer-hess-obtains-groundbreaking-victory-against-metlife-new-york-state-court-allows-plaintiffs-claims-of-consumer-fraud-and-attorneys-fees-to-proceed
