The husband had asserted the agreement as an affirmative defense against the wife's request for equita ... ble distribution of marital property. The agreement, signed prior to the parties' marriage, purported to govern the disposition of property in the event of marriage and divorce, but was silent as to choice of law. The laws of up to four countries were at issue, and the court concluded the agreement was invalid under Spanish law and the law of the Dominican Republic.
