Client was indicted for Murder and Armed Robbery after the victim was shot following a robbery. He was facing a mandatory sentence of life in prison if convicted on the murder charge. After extensive negotiations with the prosecution, client agreed to plead guilty to a reduced charge of voluntary manslaughter and armed robbery. Attorney Leon persuaded a judge to accept the plea agreement despite the judge’s concerns that it was very lenient and potentially improper due to state sentencing guidelines recommending a prison sentence of 8-12 years for manslaughter and 5-7.5 years for armed robbery. Client was then sentenced to the Department of Youth Services for 11 months until age 21 followed by four years of probation with a suspended sentence. As a result, client will serve only three years in custody on the voluntary manslaughter charge before being released to begin his term of probation.
