OUTCOME: NO JAIL in this Multi-DUI, High Blood Alcohol Level with Injury DUI Incident

Mr. W. was in California for business for a meeting with several business associates at a Casino. Mr. W. unfortunately had a bit too much to drink and drifted into a parked car. As he continued to dr ... ive out of the Casino he hit another car that had quickly stopped suddenly in front of him so as to allow a passenger to get out and take a photo. This was not Mr. W.’s first DUI related incident. As this occurred in the vicinity of a Casino the collision was captured on video and casino security personnel immediately detained Mr. W. Mr. W was later contacted by CHP and evaluated as a possible intoxicated driver. Unfortunately, Mr. W displayed objective symptoms of intoxication and had a Blood Alcohol Concentration Level of .18; over 2x’s the legal limit. Mr. W. stated that indeed he had been drinking at the Casino. Officers located several finished beers in Mr. W.’s vehicle under the front seat floorboard. Additionally, as to the people in the car that Mr. W. hit, several were claiming injuries. Outcome: Mr. Cohen got the prosecutor to treat this as a first DUI for Mr. W. Additionally, the penalty for having a High Blood Alcohol Level was dropped. Although Mr. W. was sentenced to 10 days in jail, Mr. Cohen asked, and the Judge agreed, that all jail time be suspended.

OUTCOME: After an exhaustive, 2 day sentencing hearing, Mr. B. was sentenced to Probation and NOT State Prison.

Mr. B. contacted the office very shortly after he was arrested on Felony Weapons Criminal Threat and Domestic Violence charges. He said that he needed an attorney who would fight for him and keep him ... from going to State Prison. Attempting to negotiate a plea that allowed for the possibility of arguing for Probation instead of Prison proved extremely difficult as the prosecutor, making no bones about it, said that State Prison is where Mr. B was going. After successfully getting the Judge on board with the possibility of Probation, Mr. Cohen worked extensively with an Investigator to gather facts and evidence related to Mr. B. that would afford an opportunity to argue for a Probation sentence. Mr. Cohen called 4 witnesses to the stand. One of the witnesses was Mr. B. Although this was a risk, Mr. Cohen and Mr. B prepared for over a day for Mr. B’s testimony.

OUTCOME: After careful consideration, the prosecutor chose NOT to file any criminal charges against Mr. P.; thereby avoiding any jail time or other additional consequences.

Mr. P. came to us after recently being arrested on several Felony Domestic Violence related charges. After extensively discussing the facts leading up to his arrest with him, Mr. Cohen made the decisio ... n to contact the prosecutor’s office early, before any criminal case was filed against the client. The Office next contacted Mr. P’s live-in girlfriend and quietly listened to her as she related the facts involving the dispute with her boyfriend. After a discussion with Mr. Cohen, she agreed to draft a letter outlining her position towards further punishment/prosecution, as well as her involvement in the dispute with Mr. P. The letter authored by Mr. P’s girlfriend was attached to Mr. Cohen’s letter and presented to the prosecutor’s office.
