May 22, 2020OUTCOME: NO JAIL in this Multi-DUI, High Blood Alcohol Level with Injury DUI Incident
Mr. W. was in California for business for a meeting with several business associates at a Casino. Mr. W. unfortunately had a bit too much to drink and drifted into a parked car. As he continued to dr ... ive out of the Casino he hit another car that had quickly stopped suddenly in front of him so as to allow a passenger to get out and take a photo. This was not Mr. W.’s first DUI related incident. As this occurred in the vicinity of a Casino the collision was captured on video and casino security personnel immediately detained Mr. W. Mr. W was later contacted by CHP and evaluated as a possible intoxicated driver. Unfortunately, Mr. W displayed objective symptoms of intoxication and had a Blood Alcohol Concentration Level of .18; over 2x’s the legal limit. Mr. W. stated that indeed he had been drinking at the Casino. Officers located several finished beers in Mr. W.’s vehicle under the front seat floorboard. Additionally, as to the people in the car that Mr. W. hit, several were claiming injuries. Outcome: Mr. Cohen got the prosecutor to treat this as a first DUI for Mr. W. Additionally, the penalty for having a High Blood Alcohol Level was dropped. Although Mr. W. was sentenced to 10 days in jail, Mr. Cohen asked, and the Judge agreed, that all jail time be suspended.
