Separation of family averted and expired immigration status restored
Mar 21, 2012OUTCOME: Request for discretionary approval was granted
Client came to my office after status for family members (including minor children in school) had expired. Normally an expired status cannot be extended and the individual must depart the US to pick up ... a new visa abroad. To make matters worse, the family had remained in the US for a long time, and if they departed after being in the US for another two weeks, they would then be barred from returning to the US for three years - the family would be split. We were able to convince the USCIS to restore the status for every family member retroactively.
