The State's offer was to plead guilty but without fine or jail time. Normally, that's not the worst thing in the world. Our client insisted he was innocent, and a jury agreed.

WA DLI refused to allow reopening of claimant's industrial injury claim, asserting that no objective evidence existed to support reopening. DLI said reopening statute required objective evidence. BII ... A says that there is no such requirement in the statute and that such is a creature of case law; but even so, that for some injuries (generally psychological, but in this case a physical condition known as "Peyronie's") there is no objective evidence that such could have worsened, because there is no objective criteria for its evaluation. The BIIA reversed and remanded this case, citing it as a significant decision.

OUTCOME: Plaintiff's Verdict

Charlie Escobedo was injured in an industrial accident on 8.13.03. The accident involved a 20-30 pound piece of 6" steel pipe flying off a machining lathe where it had been spinning at 850 RPMs. The ... pipe slashed Mr. Escobedo's wrist, severing tendons and nerves. The Department of Labor & Industries accepted the wrist condition. 2 years later, Mr. Escobedo claimed that his rotator cuff had also been injured in the accident. The department denied this component of the claim. The Department prevailed at the Board level. A trial of the issues was heard by a jury of 6, in Grant County Superior Court. The issue was: Was Charlie Escobedo's rotator cuff injury related to the 8.13.03 industrial accident. The verdict came back in favor of Charlie 6-0. This case demonstrated the power of a coherent theme and a good Power Point presentation.
