I represented Plaintiff and argued that the exclusion of residential tr ... eatment violated the federal mental health parity act (Paul Wellstone and Pete Domenici Mental Health Parity and Addiction Equity Act of 2008 (MHPAEA)). The Court concluded that the residential treatment services exclusion violates the Parity Act and the denial of benefits cannot be justified based on this exclusion.
