OUTCOME: Acuited of First Degree Murder, 2nd Degree Murder, Voluntary Manslaughter. Convicted of Reckless Homicide.

Homicide. First Degree Murder Charges. Client was charged with First Degree Murder after shooting her husband when he slept in their home. Using the Defense of Diminished Capacity, we were able to pr ... evail in a Jury Trial on the 1st Degree Murder, 2nd Degree Murder, and Voluntary Manslaughter. She was ultimately convicted of Reckless Homicide (a D-Felony) and received a sentence of 4 years at 30%. She is out and home today. She endured almost 40 years of abuse in her marriage, and 8 of the jurors wanted to find her not guilty of anything. Ultimately they agreed to convict on Reckless Homicide to prevent an hung jury.

OUTCOME: DUI Dismissed entirely..

Client arrested for DUI. He pulled off of the road and parked in a field, took his medications, which included sleeping medication and narcotics, and went to sleep in the back seat. At some point dur ... ing the night, he got cold, and got in the drivers seat to start the engine (and heater). He fell asleep there, and hours later someone called the police on him and they arrived to find him asleep at the wheel, with the engine running. He did, earlier in the night, put the sunshield in the windshield to block the sun as he slept... and that (coupled with the fact that he was in a 'field' and not on a roadway "where others frequent or are likely to be found") saved him. I represented the client, and went to the scene to take pictures of where he was parked... presented those to the DA, and explained the situation. Officer was could not "remember" if the sunshield was up or not... but truthfully said "it could have been". The DA agreed to totally dismiss the entire case.
