Feb 23, 2016OUTCOME: Trial court ruling against my client was reversed by the Court of Appeals.
Mother hired me to appeal the trial court's ruling, after the trial court granted father a week on/week of schedule. The father had previously only had two days a week, and no overnights. Due to severa ... l irregularities, the mother had failed to appear for trial and was not present to contest the father's evidence. The Court of Appeals granted my client's appeal, and agreed that the trial court abused it's discretion when it denied her motion to vacate the final orders because there were several irregularities in the proceedings. The Court of Appeals further agreed that the trial court failed to follow RCW 26.09.187, and thus abused it's discretion, when it established a final parenting plan. The case has been remanded to the trial court for a trial on the merits where my client can present evidence regarding what parenting plan is in her son's best interests.
