Client was charged with 4 counts of Aggravated Child Abuse, which is an A felony and carries the possible punishment of 15-25 years per offense. Aggravated child abuse involves serious bodily injury ... or a deadly weapon. The nature of these cases, however, tends to be that as soon as the age of the child is read to the jury and the pictures of the injury shown the defendant is guilty. The deadly weapon in this case? A flip flop. A dollar store, plastic flip flop used to spank the child. Overcharged. Got my client a good outcome to the case without jail time and a punishment that fits the actual crime.
