A severely depressed and highly suicidal 63-year-old psychiatric unit inpatient accessed his boating knife and attempted suicide while at Advocate Good Samaritan Hospital. The practicing tax lawyer and... CPA was admitted to the hospital’s emergency room after a failed suicide attempt. While in the intensive care unit, he attempted suicide again and was then transferred to the psychiatric unit. Upon entering it, the patient turned over his knife to an Advocate employee with a warning that he might use it to hurt himself. Despite the hospital’s protocol, the employee did not confiscate the contraband. Instead, it remained with the patient’s other possessions in his locker at a time when he was incapable of caring for himself. Early one morning, the patient removed the knife from its location and began slashing himself on the neck and on all four extremities. Although he was supposed to be observed every 15 minutes, more than four hours passed from the time he injured himself until he was discovered in shock, unconscious and in a pool of blood. A permanent brain injury resulting in loss of executive functioning resulted, and he is now disabled and cannot return to his occupation or prior level of functioning.

A 62-year-old male died from asphyxiation after a doctor negligently inserted a gastrostomy tube into his duodenum, rather than into his stomach. He had received his first g-tube in 2006 and had been f...ed by his wife for approximately 1,400 days until May 19, 2010. On that day, the doctor was running late but arrived at our client’s home to see his final patient of the day. The doctor extracted the previous g-tube and inserted a new one that went past the man’s stomach and pyloric sphincter into his duodenum, the first part of the small intestine. The inflated balloon at the end of the tube trapped the device there. While in that location, the inflated balloon tore the thin mucosa of the duodenum, which led to uncontrolled bleeding. Because of the balloon’s obstruction, blood flowed backwards into the patient’s stomach, causing him to vomit blood and asphyxiate in a chair while his wife was in bed. The doctor never confirmed through radiological findings that the tube was in the patient’s stomach. Instead, he relied on the color of the material aspirated through the tube to conclude that it was in the proper location.

A 91-year-old woman who had requested to be moved from her bed at a nursing home died from a cervical spine fracture after being dropped from a mechanical lift. A Certified Nurse Aide began the process... of placing her on the mechanical lift pad when she called for a second aide to assist. When told by the second aide that she first had to help another patient, the CNA began to transfer the patient without anyone’s assistance. During the process, the mechanical lift tipped and caused the patient to fall, hitting her head on the bedside table before she landed on the concrete floor. Although the patient reportedly was moving around and breathing but in discomfort, paramedics arrived and were unable to help her. She was later pronounced dead at the scene.

In an attempt to obtain vascular access, a resident physician attempted to place a central venous catheter into the woman’s right internal jugular vein, but negligently placed it into the right internal carotid artery and not the vein, dissecting the artery wall and resulting in a subsequent stroke. The woman remained in a state of quadriplegia as a result of the brain damage suffered from the stroke, and we reached a settlement with the hospital prior to filing suit over her injuries from the negligence
