OUTCOME: Obtained Order for Possession and a Money Judgment for Unpaid Rent Plus Costs

Joint action for possession and unpaid rent against a Chicago tenant. Tenant hired an attorney to contest the eviction and rent claim based on habitability grounds. After the parties could not reach a ... settlement, the case proceeded to trial. At trial, I successfully proved that the Defendant/Tenant was in violation of her lease by not paying rent, that no habitability issues existed within the apartment unit, and that my client was entitled to both possession of the unit and a money judgment for the unpaid rent plus court costs. The Judge awarded the Order for Possession and a money judgment in the thousands of dollars plus costs.

OUTCOME: Obtained a Reversal of Fault and Refund of Filing Fee for My Client

Landlord client was cited by City for excess trash/refuse at one of his apartment buildings. However, the trash was put there by tenants of a neighboring building, not my client's tenants. After a judg ... e held my client liable at the initial proceeding, we appealed the matter via a Complaint for Administrative Review against the City's Department of Streets and Sanitation. On appeal, the judge agreed with my argument that the City cannot hold my client strictly liable for the presence of the trash without giving him an opportunity to abate it and moreover needs to show a failure to remove the trash/nuisance. It therefore reversed the finding of fault against my client and ordered the City to refund the filing fee for the appeal.

OUTCOME: Successfully Broke My Client's Lease and Got Security Deposit Back

Illinois tenant retained me to assist her with a landlord-tenant issue. She lived just outside of Chicago and in an owner-occupied building, so the CRLTO did not apply. She was pregnant at the time and ... her apartment unit had several issues, including a leaking ceiling and potentially toxic mold growing under her sink. Fearing for her future child's safety, she wanted to explore all options to ensure the apartment was safe and that her landlord kept it that way going forward. After advising the landlord in writing that she was violating the implied Warranty of Habitability and giving her the required amount of time to fix the issues, I was able to break the lease for my client and secure her security deposit without resorting to expensive litigation, allowing her and her future baby to relocate to a safer home.
