OUTCOME: Plaintiff Verdict

Intersection collision resulting in pelvic fracture. Unrepresented plaintiff negotiated with insurance company over a two year time period. Little to no contact between the insurance carrier and the ... plaintiff in the third year following the accident. The Washington State three year statute of limitations ran without plaintiff having reached a settlement with the insurance carrier. Plaintiff then hired Nathan Henry who filed suit against Farmers Insurance Company for not notifying plaintiff regarding the three year statute of limitations. Two day trial resulting in plaintiff's verdict. Result- $85,000 settlement to plaintiff.

Plff, female age 18, unemployed. Plff contended she was driving her 1964 Volkswagen Bug through an intersection when the Def. ran a red light and struck her vehicle. The force of the impact ejected P ... lff from her vehicle. Plff's post-MVA criminal history was admitted at trial, including two (2) assaults, possession of drug paraphernalia, giving false information to a police officer and theft. $59,881 meds, 3 days in hospital following disc surgery. Plff demanded $50,000 (policy limits). Offer $43,500. Result Plaintiff verdict for $123,350.

OUTCOME: Settlement in favor of the Plaintiff

14 yr old boy swimming with friends in an irrigation canal and pond at "Beer Falls" in Kennewick, WA. The boy drowned in an irrigation culvert while trying to float through the irrigation pipe/culvert ... which runs under the railroad tracks and empties into an irrigation pond. Pllf sued both the irrigation district and the railroad for not having signs, fences, or other safety measures in place to keep the public, particularly youth, from sliding through the culvert. The irrigation district/railroad argued that the pllf was tresspassing on its property and owed him no duty of reasonable care. The presiding judge ruled at summary judgment that the pllf was not a tresspasser, rather he was a licensee and owed a duty of reasonable care by the defendants. The defendants made an interlocutory appeal seeking discretionary review by the court of appeals. The court of appeals denied discretionary review. Plaintiff settled less than a month before trial for $500,000.
