Jennifer Elizabeth Day

Jennifer “Jenna” joined Beasley Allen in 2012. She works in the firm's Mass Torts Section, investigating claims involving dangerous drugs and medical devices, after previously being a member of the Toxic Torts Section.

Notable Cases

Jenna currently works on product liability actions involving transvaginal mesh (TVM). TVM is used to repair conditions such as pelvic organ prolapse and stress urinary incontinence. Complications include erosion of the mesh into the vaginal wall, chronic pelvic pain, urinary tract infections, bleeding, painful intercourse, urinary and/or fecal incontinence, organ perforation and leg pain. Numerous surgeries are often required to remove the mesh and can be risky. For many, symptoms can be debilitating and permanent. The transvaginal mesh is manufactured by various companies, such as Bard, Boston Scientific, Caldera and Johnson & Johnson.

She also currently works on cases where women’s regular use of talcum powder in the genital area for personal hygiene has been linked to the development of ovarian cancer. As many as 2,200 cases of ovarian cancer diagnosed each year may have been caused by regular use of talcum powder products, such as baby powder and body powder in the genital area. In February 2016, a St. Louis, Missouri, jury found Johnson & Johnson liable for the death of Jackie Fox, and awarded her family $72 million in damages. In May 2016, another St. Louis jury awarded Gloria Ristesund $55 million in damages, finding Johnson & Johnson liable for Ristesund’s damages related to her ovarian cancer. Five months later, a jury found Johnson & Johnson and Imerys Talc America liable for Deborah Giannecchini’s injuries resulting from the use of Johnson & Johnson's Baby Powder for feminine hygiene, and awarded Giannecchini $70 million in damages.

For three years prior, Jenna practiced in the firm’s Toxic Torts Section, and during that time, she was heavily engaged in the multidistrict litigation stemming out of the BP Deepwater Horizon oil spill.

Jenna worked to assess and recover damages for business claimants throughout the Gulf of Mexico. Additionally, Jenna served as co-counsel to Alabama Governor Robert Bentley, and was appointed by Alabama Attorney General Luther Strange as a deputy attorney general for the state of Alabama in its oil spill litigation. She has litigated extensively on behalf of the state to recover its damages resulting from the oil spill.

Jenna is a member of the Alabama State Bar, the Alabama State Bar Young Lawyers Section, the American Association for Justice, the Alabama Association for Justice, the Alabama Association for Justice’s Emerging Leaders Section, the Montgomery County Bar Association and the Montgomery County Association’s Women's Section.

Education

Jenna earned her Bachelor of Arts degree, magna cum laude, in communication and information sciences from the University of Alabama in 2009. Jenna subsequently entered Samford University's Cumberland School of Law, earning her Juris Doctor in May 2012.

While attending law school, Jenna was a member of the American Journal of Trial Advocacy, the nation’s oldest law review dedicated to advancing trial advocacy; and was selected as a Judge Abraham Caruthers Fellow, a mentor for first year law students in legal research and writing, negotiations and moot court. She was a Scholar of Merit: Juvenile Justice Administration; and included on the Dean’s List each semester.

Background

Prior to joining Beasley Allen, Jenna, who is originally from Birmingham, Alabama, worked as a law clerk at Marsh, Rickard & Bryan, P.C., in Birmingham and was a judicial intern for the Honorable Sharon L. Blackburn of the United States District Court for the Northern District of Alabama. During her third year of law school, she focused her legal research primarily on international human rights, adoption law and child trafficking.

Throughout her life, Jenna has maintained a committed interest in international missions and has volunteered abroad with organizational ministries located in Morocco, Thailand, Mexico, Haiti, Romania and Spain. She looks forward to continued opportunities to serve the Lord, both in the practice of law and on the mission field.

She is married to Andrew Fulk, a plaintiff’s attorney in Birmingham.
