OUTCOME: Successful protection of children and award of marital property due to marital waste

Case involved a situation where the opposing party had a major drug issue that was ultimately exposed in Court. There were also children that need to be protected from the drug user. Additionally, ... the drug user destroyed marital property to the extent of having the marital residence found inhabitable. During the Court process I had the ability to undermine the reliability of the opposing parties statements where the Court protected the children for my client and awarded her full custody. I also had the ability to make the drug user parent be responsible for all clean-up costs of the marital residence and if he could not do that to have my client keep the home and all equity related to the same.

OUTCOME: Successful Injunction obtained for client against ex-husband

Client was facing harassment and stalking from her ex-husband. Client wanted to obtain an injunction against her ex-husband based upon the facts and circumstances of her case. The other attorneys withi ... n the firm did not think the client had a case. I took over the case and reviewed the facts of the case and ultimately assisted the client at a hearing in Shawano County. I went up against a 3rd generation attorney and was able to provide evidence that resulted in prevailing at the hearing.

OUTCOME: Successful appeal of an erroneous ruling at the trial/circuit court level

This case involved a situation where my client was the higher income earner and the opposing party was requesting spousal support. At the trial level the Judge ended up awarding to the opposing par ... ty a higher amount of spousal support than was justified. The Judge was very vague in the supporting details and had very little rationale to support the finding. Additionally, the Judge did not consider the opposing parties actual income. Ultimately, the decision was made to appeal this ruling. Please understand that while a case may be appealed there is often times a cost-benefit approach to determine whether or not the same is cost effective. In other words, if the appeal of a financial order will reduce the finding by less than the cost of attorney fees you may want to rethink if an appeal is appropriate. With that aside, i was able to articulate to the Judge who heard the appeal why the income of the opposing party was inaccurate and point out some further factors contained in the statute that the court is required to make findings on. At the end of the day, through this diligent representation we prevailed.
