State of Oklahoma v. Scott Welch

OUTCOME: Upon argument before the District Court the Motion to Suppress was granted. Charges dismissed and the court ruled Client is no longer required to register.

Client originally charged with Failure to Register as a Sex Offender and Sex Offender living within 1000 feet of a School. Defendant was convicted in 1994 and was required to register with the Oklahom ... a Department of Corrections. A Motion to Suppress was filed asserting the client was no longer required to register by law.

The State of Oklahoma v. Brenda Mathis

OUTCOME: Dismissed by Court

State alleged that Ms. Mathis was guilty of assault and battery with a deadly weapon by purposefully luring the victim to a location that resulted in the victim being shot at by two other co-defendants ... . The evidence at trial showed that the Ms. Mathis and the victim had been in a dating relationship. During the relationship Ms. Mathis had repeatedly given the victim money for simply being her boyfriend. After a while he began to demand it. On the day of the event he called her and demanded money. She did not want to give the money and was afraid of what he would do if she didn't give it him. A short time before they were to meet Ms. Mathis contacted a friend to obtain advice on how to handle the situation. The friend advised her to bring the victim by his house and they would have a talk with him. As the victim drove by the house, Ms. Mathis' friend who was also charged walked toward street. Co-defendant insisted that while he had a pistol on his person, it was never his intent to shoot the victim and only did so after he saw the victim brandish a firearm. Ms. Mathis maintained that she never knew what her friends would do to the victim and really only thought they would beat him up. The State called witnesses and rested. After I argued that the there was absolutely know evidence that she knew what was going to happen the court dismissed the case against Ms. Mathis.
