Our client was pulled over for a minor traffic infraction and subjected to a search and seizure of his person and automobile, by an officer of the Downey Police Department. He refused to give consent t ... o search his automobile, but the officer conducted a search along with his K9 unit and narcotics were discovered within the car. The client was charged with felony possession and transportation of narcotics. The case proceeded to a full motion to suppress evidence hearing in the Los Angeles County Superior Court-Norwalk Courthouse, and the officer was forced to testify on the stand. We were able to show through the officers testimony, and from the videotapes of the incident, that there was no probable cause or reasonable suspicion to detain our client and that the officer acted unreasonably during the encounter. At the close of the hearing the Judge ruled that the evidence was illegally seized in violation of the 4th Amendment. The evidence was suppressed and the case was dismissed.
