They can do it, but it may have nothing to do with if the district attorney prosecutes you or not. They are not bound by what the co-defendant says.

You should at least talk to an attorney. If you are okay and you have one hospital bill, you may not need an attorney. They can explain everything...

Ask the ex to provide a copy of the decree. How long was the husband to keep beneficiary? Is the child an adult yet? Do nothing without decree.
