Thrifty was a potential tenant at a planned (but unbuilt) exclusive shopping center in Newport Beach, California. Despite herculean efforts by the developer, Mariners Mile, to get all of the necessary ... government approvals to build the center, it was not possible. The lease agreement expired per its termination provision. Thrifty sued the Mariners for $30MM. After nearly 8 weeks of jury trial, Mariners prevailed on non-suit, and was ultimately awarded all of its fees and costs incurred in the litigation.
