In this case, client reached an agreement with Discover to pay her balance. She paid all her payments on time, but Discover continued to report that her balance was due. She disputed several times, p ... roviding evidence that she had satisfied her obligation, but nothing happened. We brought a lawsuit against Discover, Experian, Equifax, and Trans Union for violation of client's rights pursuant to the Fair Credit Reporting Act.

Murphy vs. Ocwen Loan Servicing, et al. - 2:13-cv-00555

This was a case that I was very passionate about. My clients went through a foreclosure. They had a second loan with Ocwen. After their foreclosure, Ocwen continued to report that the balance on the ... second mortgage was due and owing. This is despite the fact that California is an anti-deficiency state. Ocwen argued that CCP 580b did not preclude Ocwen from asserting that the balance was due and owing. This was the most frivolous argument we had to deal with. We were able to proceed with the case because the Court agreed with us that even if the debt was technically still due, it was inaccurate to report the balance on our client's credit report. This issue later went up to the California Court of Appeal in another matter and these frivolous arguments were put to rest. In the end, Ocwen paid damages to our clients for illegally and unfairly ruining their credit.
