State v. Everling
Jan 09, 2012OUTCOME: Case Dismissed
I represented a defendant in a high-profile case involving sexual abuse of a minor, State of Indiana v. Steven Everling. It was a nightmare case in which my client was wrongfully arrested, accused, tri ... ed, convicted, and sent to prison. The case went to the Court of Appeals and finally the Indiana Supreme Court, where it was remanded for a new trial. After the new prosecutor reviewed the facts, he decided that the case didn’t have merit. After deposing a key witness, a doctor, it became clear that there was no injury to the child and no evidence. My client had gone to prison. The case was dismissed after that deposition and my client’s record was expunged. Still, you can’t erase the horrific events. He was wrongfully accused, arrested, convicted of a crime that he did not commit. He spent two years in prison.
