Jul 31, 2012OUTCOME: Step mother was able to exercise father's custodial time during his deployment.
The case involves the unmarried parents of a minor child. The father [my client] was in the military. The mother had years of documented alcohol abuse. Father was deployed for one year in Iraq. Fathe ... r and the step-mother wished for the the minor to remain with the step mother during father's deployment. The matter was heavily litigated and I successfully argued that visitation during father's custodial time was appropriate under Family Code 3047. Step-mother kept primary custody of the minor child during the deployment of father.
