Driving While Impaired

My client was charged with driving while impaired while operating a bicycle. If convicted, my client would most likely be sentenced at level 1 and would be facing a maximum sentence of up to two years ... in prison and a minimum term of thirty days with probation. The evidence tended to show that the arresting officer was unable to testify that my client was operating the "vehicle" on the night of incident. Furthermore, the arresting officer was unable to conduct any standard field sobriety tests and there was no chemical analysis to prove my client was impaired.
