Perkins v. State, 279 Ga. 506, 614 S.E.2d 92
Jun 06, 2005OUTCOME: Court of Appeals reversed, in favor of the State.
This appeal was the culmination of four trips to either the Georgia Court of Appeals or the Georgia Supreme Court. Ultimately, new law was made in Georgia that holds a criminal defendant accountable fo ... r knowing the law about "subject matter" jurisdiction. Where Defendant settled his reckless driving case in the Probate Court of Whitfield County, the State was nevertheless allowed to charge him LATER with reckless driving AGAIN and vehicular homicide. My Plea in Bar, which should have been effective to end this case, was rejected by the Georgia Supreme Court.
