Phil D. Mitchell is a shareholder and vice-president of the law firm of Harris, Caddell & Shanks, P.C., one of the oldest law firms in Alabama which traces it roots back to 1872 when Colonel C.C. Harris established his law practice in Decatur. Harris, Caddell & Shanks is named one of the top law firms in Alabama by Business Alabama magazine, and is the only Decatur law firm to make this list. Phil began practicing law in 1991 with Legal Services Corporation of Alabama in Tuscaloosa but returned to his hometown of Decatur in 1993 and practiced in the firm of Edwards, Mitchell & Reeves, which was named "Best Law Firm" in the Tennessee Valley by readers of The Decatur Daily while Phil practiced there. Phil’s professional credentials include being recognized by Martindale-Hubbell’s national registry of lawyers with its AV® PreeminentTM rating which identifies a lawyer who is ranked by other attorneys and judges at the highest level of professional excellence and adherence to professional standards of conduct, ethics, reliability, and diligence in the discharge of his professional responsibilities. In 1998 Phil was awarded the Alabama State Bar Association's Pro Bono Award for outstanding service to Alabama’s Volunteer Lawyer Program. He is a contributing author for the book The Biggest Legal Mistakes Physicians Make and How to Avoid Them. He has lectured attorneys, real estate agents and rental managers upon Alabama’s most recently enacted Landlord Tenant Act. He has been named a member of Who's Who in American Law and he has been named an Outstanding Young Man of America on three separate occasions. Phil serves as local counsel and upon the Community Board of Directors for Renasant Bank in Decatur.
Phil D. Mitchell has represented thousands of clients in all types of legal matters and litigation ranging from business disputes, traffic, misdemeanor and felony criminal offenses to complex civil litigation. Phil has been successful in representing and defending individuals and businesses in connection with automobile accidents, work related injuries, frauds and faulty constructions. Phil’s clients, other than individuals, include commercial contractors, commercial and residential developers, apartment complexes, rental owners, banks and other lending institutions, churches and other charitable organizations, residential builders and construction contractors, physicians, municipalities and various businesses. Phil has a steady transactional practice including home purchases, mortgage loan closings, commercial lending closings, wills, and corporate matters including the formation, sale or purchase of business entities and properties. Phil has helped numerous people obtain the Social Security Disability and SSI benefits they were due, but initially denied. Phil has served as a Construction Law Attorney member of the American Subcontractors Association of Alabama.
Phil D. Mitchell practices in all courts in the State of Alabama and holds bar memberships with the United States District Court and the United States Bankruptcy Court for the Northern District of Alabama; with the Alabama State Bar Association; and with the Morgan County Bar Association. He currently serves on the state bar’s board of directors as the Bar Commissioner for Alabama’s 8th Judicial Circuit. Phil has served as Chairman of the State Bar's Committee on Access to Legal Services, as Chairman of the State Bar’s Committee to Celebrate Pro Bono Week and he currently serves as Vice-President and a member of the board of directors of Legal Services Alabama, Inc. which is a statewide non-profit corporation dedicated to providing access to justice and quality civil legal assistance to Alabama’s low-income community. Phil has served as a member of the Bench and Bar Committee of the Morgan County Bar Association and as President, Vice-President and Treasurer of the Young Lawyers Division of the Morgan County Bar Association. Phil is a Registered Mediator with the Alabama Center for Dispute Resolution and the Alabama Supreme Court Appellate Mediation Program.
Phil D. Mitchell is a 1983 graduate of Decatur High School. In 1987 he graduated from Jacksonville State University with a Bachelor of Science Honor's Degree. He graduated from the University of Alabama School of Law in 1991. While attending Jacksonville State University, Phil was a member of the Kappa Alpha Order and received that organization's Freshman Scholarship Citation. Phil was awarded academic scholarships while attending both Jacksonville State University and the University of Alabama. He has served his church and community as a member and elder of Westminster Presbyterian Church in Decatur; as a member of the Business Affairs Committee of the North Alabama Presbytery; as a member of the Board of Directors of the Committee on Church Cooperation; as a member of the Board of Directors and President of the Kiwanis Club of Decatur; as Cub Master and Den Leader for Cub Scout Pack 260; as a member of the Beautification Committee of the Decatur-Morgan County Chamber of Commerce; as legal counsel for Helping Adolescents in Need of Direction and Supervision (HANDS) which formed a group home for troubled girls in Decatur; and as legal counsel for Big Brothers/Big Sisters of Morgan County, Inc. Phil actively serves in numerous capacities for Ducks Unlimited at the local, state and national levels, including having served as a National Trustee, and having served on the Board of Directors of the Friends of the Wheeler National Wildlife Refuge.
