JURY ACQUITS MAN OF MOST SERIOUS CHARGES

OUTCOME:

Following two and a half days of deliberation, an Allegheny County jury acquitted my client of the most serious charges alleged against him including, robbery, kidnapping, criminal conspiracy to commit ... homicide, and criminal solicitation of homicide. The defense argued to the jury that the victim’s story didn’t add up. The video surveillance did not show physical force or aggressive behavior and further, shows one of the accused robbers hand the victim back his ATM card and a receipt for the transaction.

FIREARM CHARGES DISMISSED BY THE COURT

OUTCOME:

My client was charged with person not to possess a firearm stemming from the recovery of a firearm from a residence that he was visiting. I argued that the fact that my client was present in the home ... was not legally sufficient grounds to hold the charge for further court action. The magistrate presiding over the matter agreed and dismissed the charges following a preliminary hearing.

My client was facing serious prison time as a result of a second felony drug charge. Specifically, the standard range sentence in this case was 4-8 years. Rather than go to trial, our strategy was to ... highlight the strong mitigating circumstances present in this case and enter a plea of guilty before the judge. Following argument, my client was sentenced a probationary term of 3 years.

OUTCOME:

My firm was hired to defend a man charged with falsification of documents to authorities and illegal purchase/transfer of a firearm in connection with his attempt to lawfully purchase a gun. As a resu ... lt of our client’s prior background, he was not eligible to purchase and/or own a firearm, however was unaware of such ineligibility. At the preliminary hearing held in this matter, I argued that the client did not have the requisite intent to deceive in his attempt to purchase the gun in question. Following a hearing and argument concerning the same, the court dismissed both charges.

I represented a client in a non-jury trial before an Allegheny County Court of Common Pleas Judge that resulted in a full acquittal. At trial, I argued that the Commonwealth’s evidence was insuffi ... cient to prove beyond a reasonable doubt that my client was aware that a robbery had occurred and/or that he had any involvement with such criminal acts. Further, I argued that the firearm in question could not be definitively linked to my client and that the controlling case law required the judge to find my client Not Guilty.

McKEESPORT MAN ACQUITTED BY A JURY OF ATTEMPTED HOMICIDE

OUTCOME:

I was appointed to represent a young man facing multiple serious charges in connection with a 2012 shooting. Although my client had no prior criminal history, he was accused of attempted homicide, ass ... ault of a law enforcement officer, aggravated assault, reckless endangerment of another person, multiple firearm violations, robbery, burglary and criminal conspiracy. From the beginning, our defense was that he had been misidentified and that the reliability of the eyewitnesses, including police officers at the scene, was in serious question. In addition, the defense presented DNA evidence to the jury that had been gathered from the crime scene from two individuals – neither sample matched the DNA of my client. Following a 4-day jury trial, the jury sided with the defense finding my client Not Guilty of all charges.

MAN WHO WAS SHOT BY POLICE IN SOUTHSIDE CHASE ACQUITTED OF CHARGES

OUTCOME:

An Allegheny County jury acquitted my client of more than two-dozen charges that arose from a police chase in the Southside section of the City of Pittsburgh that ended in police gunfire. The purs ... uit began when my client allegedly ran a red light in Homestead and failed to stop when police attempted to pull him over. The vehicle continued into Southside around 2:00 a.m. as bars were letting out. At or around 13th Street, multiple officers opened fire into the vehicle striking both the client and his mother, the front seat passenger of the vehicle. Another bullet grazed a pedestrian. Multiple shots were also fired into an unrelated vehicle. Two weeks after the shooting, then-city police Chief Nate Harper issued an order prohibiting officers from firing into a moving vehicle “unless there are shots being fired from that vehicle.” At trial, officers testified that they were in fear of the approaching vehicle. My client faced 13 felony counts of aggravated assault and 14 counts of recklessly endangering another person but we argued that such charges were unsubstantiated by the evidence, the jury of 9 men and 3 women agreed.

WILKINSBURG MAN FOUND NOT GUILTY IN ALLEGED DRUG ROBBERY

OUTCOME:

My client was accused of attempted homicide, robbery, aggravated assault, and carrying a firearm without a license. This was a textbook self-defense case. At trial, I argued that the alleged vic ... tim and my client provided similar accounts of what occurred to the jury – except for one large discrepancy – who the robbery target was. The defense maintained that it was the defendant who was actually the victim of an attempted armed robbery and during a struggle to disarm the alleged victim, he was shot. After deliberating only about 30 minutes, the jury returned a verdict of Not Guilty as to all charges.
