Motor vehicle collision. Plaintiff was driving her nephew to school in Lakewood, Washington, and was stopped for traffic when her vehicle was struck from the rear by the defendant's vehicle. Plaintiff ... sustained low-back pain and anxiety while driving. Plaintiff only sought treatment at the emergency room on the date of the collision where she was treated and released, and did not receive any additional treatment after the date of the collision. This was an appeal by the insurance company from an arbitration (trial de novo) where Plaintiff was awarded $ 25,806, inclusive of costs, by the arbitrator. Post trial, Plff was awarded an additional $51,191 in attorney fees and $6,178 in costs because the insurance company appealed the arbitration award and did not improve the insurance company's position.
