Overturned a district court summary judgment decision against our client S.J. Amoroso in an appeal before the U.S. 9th Circuit Court of Appeals in a breach of contract action against an insurer for wro ... ngful denial of coverage. Insurer denied coverage on a claim against a D&O policy asserting that the President of the company acted in his individual and not his corporate role when he wrote a letter that caused alleged liability. The district court granted a summary judgment motion by the insurance company upholding that basis for denial. The Court of Appeal overturned the summary judgment and remanded the matter to the district court for further consideration of Amoroso's breach of contract claim. Mr. Parent drafted all briefs submitted to the court on behalf of S.J. Amoroso, the prevailing party.
