The plaintiff sued Dollar Tree Stores for violation of the Family Medical Leave Act (FMLA). Dollar Tree Stores offered the plaintiff leave benefits under Dollar Tree Stores' internal policies but asse ... rted that the plaintiff was not an eligible employee under the FMLA because she had not been employed by Dollar Tree Stores for the requisite time period under the statute. The plaintiff admitted that she had not been employed by Dollar Tree Stores for the requisite time period, but contended that Dollar Tree Stores was a successor in interest (within the FMLA) to the plaintiff's previous employer. The district court granted Dollar Tree Stores' motion for summary judgment and dismissed all of plaintiff's claims against Dollar Tree Stores, concluding that it was not a successor in interest under the FMLA. The plaintiff appealed. As a matter of apparent first impression, the Ninth Circuit held that pure legal conclusions are not admissible as factual findings pursuant to hearsay exception for public records and reports. The Ninth Circuit affirmed the trial court's order of dismissal. See 2010 WL 3733576

Intervest Mortgage Investment company brought an action against the guarantors of a defaulted loan that was issued to finance a construction project, seeking to collect on a personal guaranty and alleg ... ing breach of guaranty agreement and violation of California's Uniform Fraudulent Transfer Act (UFTA). On behalf of Intervest, we moved for partial summary judgment on liability. The federal district court held that the guarantors retained unreasonably small assets in relation to their business at the time of the challenged transfers and granted summary judgment for Intervest on liability under the UFTA.
OUTCOME: Directed verdict for Defendant.
