Perhaps. If you were to do that, your roommate could still likely come after you for stiffing him/her on rent for this last month.

It sure doesn't sound like it. Police generally have pretty wide latitude to ask questions in a traffic stop.

What does 30 days suspended for 1 year probation and does the person get credit towards that if there already in jail.

The law requires that you be given credit for the time you've already spent in jail.
