In filing a Chapter 7 bankruptcy, all debts listed or not listed, known or unknown, are discharged due to identify theft possibility. Complainer is uninformed and obviously not contacted me. I believe this is from a competitor - timing is too coincidental. In U.S. Bankruptcy Ct., No. Dist. of AL, Southern Div., Case No. 05-2646-TOM-7, In Re: Claudette Dunner Reese, Debtor, in Memorandum Opinion and Order Denying Debtor's Motion in Part and Granting Motion in Part, issued Jan. 18, 2008, Tamara O. Mitchell, U.S. Bankruptcy Judge stated, in part: "The listing of a debt in the schedules is not a condition of its discharge under 11 USC, Sect.727. That section provides that the debtor is 'discharged... from all debts that arose before the date of the order for relief.' Nothing in Sect. 727 prevents an unscheduled debt from being discharged."
