I helped a client create an estate plan addressing both incapacity and death. We discussed possible scenarios and prepared documents so her family would know what to do if those circumstances arose. ... Unexpectedly, the client became seriously ill soon after the plan was completed, and several of the situations we had anticipated became reality. Because the planning was already in place, her family avoided many of the complications that can accompany an unexpected health crisis, including difficulties with banks and medical providers. Most importantly, the family could focus on what really mattered—the client's health and well-being—rather than trying to figure out what to do next. This experience reinforced that estate planning isn't just about death. Good planning can reduce stress and provide protection when illness or incapacity occurs during life.
