The plaintiff/ patron was involved in a motorcycle accident after leaving the defendant's bar while intoxicated. The Plaintiff, a master electrician, survived the accident but lost use of his left arm ... . The Plaintiff claimed that the defendant bar knew or should have known that he was a habitual alcoholic because during his thirty day vacation in the Miami area he had gotten drunk in that bar on 28 days. The plaintiff was able to satisfy Florida's Statutory requirement that a bar can only be held responsible for the acts of an inebriated customer if the plaintiff can prove that the bar knew or should of known that the customer was habitually addicted to alcohol and it nevertheless served him alcohol to the extent that the customer became drunk and injured himself or others.
