Plaintiff is parent of child who attended private pre-school and kindergarten program. The claim stated Defendant program breached the contract by not adequately preparing child to perform academicall ... y at the level necessary for entering 1st Grade in public school. Defendant argued the program did all that was required and parent failed to work with child to ensure child's understanding and comprehension of the materials. Child tested badly upon entering 1st Grade, and child's competency measured behind almost all other children. Plaintiff's claim asked for partial cost of the tuition paid to Defendant program, plus all out-of-pocket costs for the special tutoring child needed to catch up with other first-graders.
