California Court of Appeal for the 5th District found that because Modesto's business license tax failed to fairly apportion the receipts of a taxpayer engaged in business inside and outside the city, ... it was unconstitutional. I developed this case while working for KPMG, LLP, a Big 4 Accounting Firm which was not allowed to practice law; thus, Chuck Moll of Morrison and Foerster, LLP argued it in all court proceedings on the client's behalf.
