Claim by widow to recover a retirement account her husband had given away to his brother before his death
N/A
OUTCOME: $238,117.57 recovered by settlement
The widow's husband had taken his income during his life (which is community property, jointly owned by the spouses) and gave all of it to his brother right before he died. That is a fraud on the estat...e, meaning that the wife's 50% interest has essentially been stolen by her husband's brother. Even though the husband has a right to give away his 50%, he cannot give away 100% of their community property.
