The prosecution’s evidence consisted of testimony from the alleged victim, the alleged victim’s 12 yr-old son, one of the investigating officers, and photographs showing injuries to the alleged victim. The defense argued that the alleged victim was the primary aggressor, that alleged victim’s version of the struggle was inconsistent with the allegations of assault and that the defendant only pulled the women apart to prevent injury to his current girlfriend. The jury returned a verdict of Not Guilty.

The prosecution’s evidence consisted of the items found in the vehicle, testimony from the investigating officer (a drug recognition expert), and a blood test showing the defendant to have had marijuana in his system. The defense argued that the defendant did not knowingly possess the items found in his vehicle. The jury returned a verdict of Not Guilty to both charges.
