OUTCOME: Farm Bureau successfully appealed the District Court's Summary Judgment in favor of Lopez to the Idaho Supreme Court, 145 Idaho 515, 224 P.3d 1104.

This case involved application of the "common fund doctrine" regarding attorney's fees when Lopez allegedly recovered the subrogated interest of Farm Bureau when not permitted to do so by Farm Bureau.
