DWI Evidence Suppressed and Case Dismissed
May 18, 2015OUTCOME: Case Dismissed
Client stopped for DWI after leaving a bar. Officer observed Client spin and screech his tires leaving a red light and pulled him over. Client performed poorly on field sobriety exercises and refused ... to provide a breath or blood sample. Attorney Kuhlmann filed a Motion to Suppress all evidence in the case. At the hearing on the motion, the Assistant District Attorney was unable to overcome Mr. Kuhlmann's argument that the officer did not have sufficient grounds to pull over client. The court granted Mr. Kuhlmann's Motion to Suppress. The District Attorney's Office was forced to dismiss the entire case because none of their evidence would be admissible at trial due to Mr. Kuhlmann winning the motion hearing.
