The State of Florida had removed the child from his father alleging that the father neglected his child because he did not cooperate with ... the State, because he had an extensive criminal history involving drug charges, and because he allegedly fled the state, abandoning his child with a relative. The father went to trial and argued that even if he had drug charges, the State did not prove that the child was harmed. The father also argued that he temporarily left the state and did not abandon his child. The trial court adjudicated the child dependent. Rothrock Law Firm represented the father on appeal and argued that the record was devoid of legally sufficient evidence to uphold the decision. The State confessed error and the Second District Court of Appeal reversed the decision.
