OUTCOME: Not Guilty. Court held that because the officer never asked when he finished drinking it is possible that he consumed right before driving and BAC would be below .08 at the time of driving

My client was arrested by McKinney PD for driving while intoxicated. Failed all three SFSTs. He gave a sample of his breath and blew above a .15.
