Plaintiff alleged individual liability as against defendant's sole member. Defendant counterclaimed for lost profits.

Plaintiff, residential home builder, recorded a claim of lien for amounts due on residential construction contract executed with defendant developer. Suit was filed to foreclose mechanic's lien and de ... fendant developer counterclaimed asserting breach of contract and construction defect. Mediation failed, and the case was tried before a jury resulting in recovery of a principal amount in excess of the amount of the claim of lien, prejudgment interest and attorney's fees.

OUTCOME: Settlement in advance of trial.

Defendant construction company leased portions of plaintiffs' residential property to stage equipment and temporarily stockpile excavated fill from a public utility construction project. Pierce County ... asserted that the temporary stockpiling violated county development and environmental protection regulations and caused plaintiffs to remove excavated fill incorporated into its property. Plaintiffs brought suit against defendant claiming trespass, waste, negligence, tortious interference and breach of contract, asserting that defendant's actions had spoilied plaintiffs' attempts to market the property and caused them to incur remediation costs. Defendant tendered the claim to its liability carrier who filed suit in federal court claiming it had no duty to indemnify defendant. Plaintiff settled less than a month before trial for a small fraction of its last offer at mediation, payment of which was made, in part, by the defendant's carrier.
