Yes. If you agreed and your lawyer acted upon it., there is an agreement. Courts uphold such agreements. There does not have to be a writing.

An intentional act such as this is outside the scope of workers compensation, so you can sue him for battery and all the damages that come with it....

General contractor is liable ultimately and it is a workers compensation claim. To protect yourself, contact your homeowner's insurance company.
