You are not required to probate an estate with no assets in Florida.

Your new spouse could contest and would be entitled to a spousal share. best bet would be to get a premaritla agrrement and waiver.

I agree with above answers. Only minors and spouses have automatic rights to an inheritance.

IRA's usually have beneficiares. Without beneficiares-the asset would have to go through probate.
It is best to have a probate attorney assist.
