Too many types to count and trusts can be created for many types of special purposes.
The standard trusts avoids probate and guardianship as well...

It depends on if this is a first or second marriage and also if you have children.
Your best bet would be to have a will or trust that leaves it...

I was the conservator of brothers trust. When he passed away. I used the money. My parents sued me and won.

Judgments can be discharged in bankruptcy.
Have a bankruptcy attorney review the matter with you.

If the check is from the sale of the home and it is already in probate-the attorney representing the probate estate should be handling this for you...

You would need solid evidence and it is usually obtained in depositions.
