Client was charged with a second DUI within five years of a prior (requiring mandatory jail and a five year D/L revocation if convicted). This matter went to a jury trial and the jury returned a "hung ... verdict" with five believing that the client was not guilty. Subsequent to the trial, the State agreed to reduce the charge.
OUTCOME: Motion to Suppress GRANTED.
Defendant was charged with DUI after being stopped for "failing to maintain a single lane." Of course, the "bad driving" was not captured by the officer's in-car video camera. Tim used a creative str ... ategy in hiring a math student to calculate the time of driving not captured on camera but allegedly observed by the officer--which revealed a negligible amount of time. The Court ultimately did not find the officer credible and suppressed the traffic stop which resulted in ALL EVIDENCE BEING SUPPRESSED.
