No new evidence is allowed in an appeal. The trial's evidence may be reviewed on appeal, depending on the case.

Yes. The two cases have much lower standards. A new charge is beyond a reasonable doubt. A vop is to the conscience of the court.

your probation cannot be violated for a civil infraction.
