Plikaytis v. Roth
N/A
OUTCOME: Nearly $9.5 million plus property worth $350k
Plikaytis v. Roth was a complicated case arising from an employment relationship of 25 years. Ultimately, Anice Plikaytis and James Roth had multiple business dealings. Among them, Roth and Plikaytis... became partners in a real estate deal resulting in condominium construction, Roth's delays and mismanagement of the project was one of the issues in the case, and resulted in an award of approximately $3 million.
In another deal, Roth promised Plikaytis a 25% share in another development. After firing the Plaintiff, he denied making that promise. De La Flor proved this contract and proved, again, that Roth's mismanagement prevented this deal from going forward. Plikaytis was awarded damages of $2.8 million on this deal.
The total judgment was for nearly $9.5 million, plus a piece of property valued at between $300,000 and $400,000.
Verdict included $2.5 million in punitive damages.
This is believed to be one of the highest verdicts in San Diego County in 2009, and one of the largest employment law verdicts for a single Plaintiff in the State of California for 2009.
